1. Agreement to Terms
These Terms and Conditions (“Terms”) form a legally binding agreement between you (“you” or “customer”) and TOFECOL LTD (“we”, “us”, “our”). By accessing and using our website (https://www.tofecol.com/) and related services (“Site”), you agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. Eligibility
You must be at least 18 years old or have legal parental or guardian consent to use our Site.
3. Orders and Cancellations
Some of our items are made to order and considered bespoke.
• For made-to-order/bespoke items, you may cancel your order before it has been dispatched. Once dispatched, these items are not eligible for cancellation, return, or refund, except in the case of faulty or incorrect goods.
• For non-made-to-order items, you have a legal right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your order within 14 days of delivery for a full refund, even if the order has been dispatched.
• To cancel an order, please email us at customerservice@tofecol.com with your order number.
4. Returns and Exchanges
• For non-made-to-order items, returns must be initiated within 14 days of delivery. Items must be unused, in their original condition, and with all original tags and packaging.
• For made-to-order items, we do not accept returns or offer refunds, except where the item is faulty or not as described.
• We offer store credit or exchanges for unworn items in their original condition if there is an issue with sizing.
• Return postage is the customer’s responsibility (except for faulty/incorrect goods). We recommend tracked and insured shipping.
• We are not liable for any customs duties, taxes, or delays during the return process.
• Important: Orders placed using store credit from a previous return are not eligible for another return. Store credit is valid for one year and cannot be combined with promotional offers.
5. Faulty or Incorrect Items
If an item is faulty, damaged, or incorrect, please contact us at customerservice@tofecol.com within 14 days of receipt, including photos and order details. We will cover return postage and provide a replacement or refund.
6. Intellectual Property
All content on the Site — including designs, images, logos, text, and software — is owned by or licensed to TOFECOL LTD. You may not reproduce, distribute, or use our content for commercial purposes without prior written consent.
7. Third-Party Links
Our Site may contain links to third-party websites. We are not responsible for these third-party sites or their content.
8. Site Management
We reserve the right to:
• Monitor the Site for violations of these Terms.
• Take legal action against users who violate these Terms or applicable law.
• Restrict or terminate access to the Site at our sole discretion.
9. Privacy and Data Protection
We handle your personal data in accordance with our Privacy Policy, which is incorporated by reference into these Terms. The Site is hosted in the UK. By using the Site, you consent to your data being processed and stored in the UK.
10. Limitation of Liability
We do not exclude or limit our liability for death or personal injury caused by negligence, fraud, or any matter that would be unlawful to exclude.
To the fullest extent permitted by law, we will not be liable for indirect or consequential losses, or for any loss of profit, data, or goodwill arising from use of the Site.
11. Consumer Rights
Nothing in these Terms affects your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. You may bring claims in the courts of your habitual residence if you are a UK or EU consumer. Otherwise, disputes shall be subject to the exclusive jurisdiction of the courts of England.
