This website is operated by TOFECOL LTD. Throughout the Site, the terms “we”, “us”, and “our” refer to TOFECOL LTD. TOFE offers this website, including all information, tools, and services available from this Site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our Site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms and Conditions (“Terms”). These Terms apply to all users of the Site, including, without limitation, browsers, customers, and contributors of content. Please read these Terms carefully before accessing or using our website. By accessing or using any part of the Site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services.
Any new features or tools added to the current store shall also be subject to these Terms. You can review the most current version of the Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc., which provides the online e-commerce platform that allows us to sell our products and services to you.
1. Eligibility and Online Store Terms
By using the Site, you confirm that you are at least the age of majority in your place of residence, or you have consent from a parent or legal guardian. You agree to use the Site and our products for lawful purposes only. You must not transmit any viruses, malware, or harmful code. A breach of these Terms will result in immediate termination of your access.
2. Orders, Production and Cancellations
Many TOFE pieces are made to order.
- You may request to cancel an order before dispatch. If production has already begun, cancellation may not be possible. If we cannot cancel, you can still return the item after delivery in line with section 3.
- For ready-to-ship items, cancellation before dispatch is usually possible. If the order has already shipped, please follow the returns process in section 3.
- We reserve the right to refuse or cancel any order for reasons including suspected fraud, stock issues, or pricing errors. If we cancel, we will refund you in full.
3. Returns, Exchanges and Refunds
We accept returns provided you follow the steps below.
Notification period
You must notify us of your intention to return within 14 days of receiving your order. Please email customerservice@tofecol.com with your order number. Once we approve the return, you must return the item within 14 days of notifying us.
Condition
Items must be returned in original, resaleable condition. This means unworn, unwashed, and undamaged, with all tags and original packaging included. Items with marks, stains, odours, pulled threads, missing accessories, or removed tags will be rejected and sent back to you.
Hygiene items
Swimwear must be tried on over underwear and returned with the hygiene liner and tags attached. If the seal or liner has been removed or damaged, we may refuse the return for hygiene reasons.
Return shipping
Return postage is your responsibility unless the item is faulty or incorrect. We recommend a tracked and insured service. If a return is lost in transit and no valid tracking shows delivery to us, we cannot process a refund.
Refunds
When a return is approved, refunds are issued to the original payment method within 5 to 10 working days of receipt and inspection. Original shipping charges are non-refundable unless we sent a faulty or incorrect item.
Exchanges and store credit
If you prefer an exchange, we will do our best to accommodate if stock is available. Where an exchange is not possible, we can issue store credit.
- Store credit does not expire.
- Orders placed using store credit are final sale and are not eligible for a further return.
- Store credit cannot be exchanged for cash and cannot be combined with promotional codes.
Return rejections
If a return does not meet these requirements, it will be rejected and sent back to you. We will notify you with photographs where relevant.
Pop-up and sample sale purchases
Please note that all purchases made at pop-up events and sample sales are final sale. We do not accept returns or exchanges for these items under any circumstances.
Return costs and shipping fees
Original shipping fees are non-refundable.
4. Faulty or Incorrect Items
If you receive an item that is faulty or incorrect, please email customerservice@tofecol.com within 7 days of delivery and include clear photographs and your order number. We will assess the issue and arrange a repair, replacement, or refund. We will cover reasonable return postage for confirmed faults or errors.
Your statutory rights under the Consumer Rights Act 2015 remain unaffected.
5. Customs and Import Duties
You are responsible for any customs duties, taxes, and handling fees charged by your local authority on import or on return shipments.
United States orders
As of 29 August 2025, the United States has suspended the de minimis duty-free treatment for low-value imports. Most shipments entering the US may now attract duties and other import charges. We cannot control these charges and they are payable by you on delivery.
Returns from outside the UK
Please clearly mark the parcel as Returned Goods, include your original order number and any paperwork required by your local carrier. If import charges are applied when your return re-enters the UK, we will cover up to £20 in such charges. Any amount above £20 may be deducted from your refund.
We declare shipments in accordance with applicable customs laws. We cannot mark orders as gifts or undervalue the contents.
If you refuse to pay import charges and the parcel is returned or destroyed by the carrier, we may deduct all related costs and outbound shipping from any refund, or we may not be able to refund at all if the goods are not returned to us.
6. Chargebacks and Abuse
If you initiate a chargeback or payment dispute against our business, you will be permanently banned from shopping with us. All future orders associated with your name, email, address, or payment details will be immediately cancelled.
If you make or threaten to make false claims, to post defamatory content about TOFECOL or our staff on social media or review platforms, or to otherwise harass or abuse our team, we will treat this as consumer abuse. Such behaviour will also result in a permanent ban and immediate cancellation of any future orders.
We reserve the right to pursue all available remedies, including civil action, where we consider it necessary to protect our business and staff from defamation, harassment, or fraudulent activity.
7. Accuracy of Information
Content on the Site is provided for general information and may change. We do not guarantee that information is complete, accurate, or current.
8. Modifications to Service and Prices
We may change prices, products, or services at any time. We may suspend or discontinue the Site or parts of it without notice. We are not liable to you or any third party for such modifications.
9. Products and Services
We try to display colours and finishes accurately. The colour you see depends on your device and we cannot guarantee exact matches. We may limit quantities or refuse orders where appropriate, including suspected resale.
10. Accuracy of Billing and Account Information
You agree to provide current and accurate contact, billing, and delivery details and to keep them up to date.
11. Optional Tools and Third Parties
We may provide access to third-party tools or services which are provided as is and as available. We are not responsible for third-party content, policies, or practices.
12. User Comments and Submissions
If you submit reviews, comments, or content, you grant us a non-exclusive, royalty-free licence to use, reproduce, and publish that content. We may remove content that is unlawful, abusive, or infringes rights.
13. Errors and Omissions
We may correct errors, inaccuracies, or omissions and cancel or update orders affected by them.
14. Prohibited Uses
You must not misuse the Site, including attempting to gain unauthorised access, introducing malicious code, infringing intellectual property, harassing others, or breaking any applicable law.
15. Shipping and Delivery
We ship using trusted carriers. Estimated delivery timeframes are provided at checkout and in your confirmation email. Delivery times are estimates only. We are not responsible for delays caused by customs clearance, weather, or carrier issues beyond our control.
16. Intellectual Property
All designs, product images, logos, photographs, and text on the Site are owned by or licensed to TOFECOL LTD. You may not reproduce or use our content for any commercial purpose without our written permission.
17. Third-Party Links
Our Site may link to third-party websites. We are not responsible for the content, accuracy, or practices of those sites.
18. Site Management
We may monitor the Site, restrict or terminate access, and take legal action where we consider it appropriate in order to protect our rights and other users.
19. Privacy and Data Protection
Your personal data is processed in line with our Privacy Policy, which forms part of these Terms. By using the Site, you consent to your information being processed and stored in the United Kingdom.
20. Disclaimer of Warranties
Except as required by law, the Site and our services are provided as is and as available. We do not guarantee uninterrupted, timely, secure, or error-free service.
21. Indemnification
You agree to indemnify us against losses arising from your breach of these Terms or violation of law or third-party rights.
22. Severability
If any part of these Terms is found unenforceable, the rest remains in force.
23. Limitation of Liability
Nothing in these Terms limits or excludes liabilty for death, injury, or fraud. We are not liable for indirect or consequential loss or for loss of profit, data, or goodwill.
24. Termination
We may suspend or terminate access immediately if you breach these Terms or engage in abusive, fraudulent, or unlawful conduct. You remain liable for amounts due up to termination.
25. Changes to Terms
We may update these Terms from time to time. Updates apply once published here.
26. Consumer Rights
Nothing in these Terms affects your statutory rights under UK law, including the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013.
27. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. UK and EU consumers may bring claims in their local courts; otherwise, disputes fall under the exclusive jurisdiction of English courts.
